Terms of Service

Effective date: 22 October 2026

Draw Paw ("Draw Paw", "we", "us", "our") is an online service based in New South Wales, Australia. You can contact us at hello@draw-paw.com.

These Terms apply when you use https://draw-paw.com (the "Site") and when you buy a portrait from us. Please read them together with our Privacy Policy and Refund & Redo Policy. By uploading a photo or placing an order, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other consumer protection law that applies to you and cannot lawfully be excluded. If you live in the European Union or the United Kingdom, you also keep the protection of the mandatory consumer laws of your country.

1. What Draw Paw does

1.1 You upload a photo of your pet, choose one of our art styles and, if you like, add your pet's name to be lettered onto the artwork. We use an artificial intelligence (AI) image model provided by OpenAI to generate a portrait.

1.2 Before you pay, we show you a free, small, watermarked preview (about 560 pixels). If you're happy with it, you can pay a one-off price to download the full digital file.

1.3 What you get: one digital image file in JPEG format, 1024 × 1536 pixels, without the watermark. At that size it prints sharply up to about 10 × 15 cm (4 × 6 in). Larger prints are possible but may look soft or pixelated.

1.4 What you don't get: Draw Paw is a digital download only. We do not print, frame or ship anything.

2. Who can use Draw Paw

2.1 You must be at least 18 years old, or have the permission and supervision of a parent or guardian who agrees to these Terms on your behalf. You must be legally able to make a payment with the payment method you use.

2.2 You may use the Site for your own personal purposes. You must not use automated tools to access the Site, try to get around our bot protection or rate limits, or interfere with the Site's security or operation.

3. Your photos and text

3.1 Your promise to us. When you upload a photo or enter a pet name or other text ("Your Content"), you confirm that:

3.2 Please upload photos of pets, not people. Draw Paw is designed for animal portraits. Please don't upload photos that show other people, especially children, or that show personal information such as addresses or number plates.

3.3 Permission you give us. You keep any rights you have in Your Content. You give us a non-exclusive, worldwide, royalty-free licence to use, copy, process and transmit Your Content (including sending it to our service providers, such as OpenAI) only as needed to generate your preview and portrait, deliver your order, provide customer support, prevent abuse and comply with the law. This licence ends when we no longer hold Your Content, except for copies we must keep by law.

3.4 We may refuse. We, or our AI provider's safety systems, may decline to process any photo or text that we reasonably believe breaches these Terms or the law. If that happens before you pay, you won't be charged.

4. About AI-generated artwork

4.1 Every portrait is unique. AI image models produce variations. The portrait will be an artistic interpretation of your photo in the style you choose. Colours, markings, proportions, backgrounds and lettering may differ from your photo or from our style examples.

4.2 It may not be perfect. AI output can contain imperfections, such as unusual details or lettering that is not exactly right. That's why we show you a preview before you pay: please check the preview carefully, including the spelling of your pet's name. The file you download will be the same artwork as the preview, at full size and without the watermark.

4.3 If the file you receive is not the artwork you previewed, is corrupted, or has a significant defect that wasn't reasonably visible in the preview, our Refund & Redo Policy applies.

4.4 Content Credentials. The full-size file you download may contain embedded provenance information ("Content Credentials", based on the C2PA standard) added by our AI image provider, which identifies the image as AI-generated. We don't add personal information to it, and we don't remove it. Some apps and websites can read or strip this information.

5. Who owns the portrait, and how you may use it

5.1 Limited copyright in AI artwork. In many countries, including Australia and the United States, material generated by AI without sufficient human creative input may not be protected by copyright, or the position may be unclear. We don't promise that anyone (including you or us) owns copyright in the portrait, and we can't stop others from creating similar images.

5.2 Your licence. To the extent we have any rights in the portrait, when you pay in full we grant you a non-exclusive, worldwide, perpetual, royalty-free licence to use, copy, print and share your portrait for personal, non-commercial purposes — for example, printing it for your home, giving it as a gift, using it as a phone wallpaper or posting it on your personal social media.

5.3 Commercial use. Personal use does not include selling the portrait or products featuring it (such as prints, mugs, T-shirts or stickers), or using it in advertising or to promote a business. If you'd like to use your portrait commercially, email us at hello@draw-paw.com and we'll let you know whether and on what terms we can allow it.

5.4 What we keep. We claim no rights in your portrait beyond what we need to run the service. We will not use your portrait or Your Content in our marketing unless you separately give us permission.

5.5 Our Site. Our Site, brand, style names, style examples, watermark and software belong to us or our licensors. You may not copy or remove the watermark from previews or use the previews for any purpose other than deciding whether to buy.

6. Prices, currency and taxes

6.1 Our base price is US$29 per portrait. We show the price in your local currency where available (for example, in Australian dollars, pounds or euros). The price shown at checkout is the total price you pay us for the portrait.

6.2 Prices shown include any GST, VAT or similar consumption tax that we are required to collect, unless we clearly say otherwise at checkout.

6.3 If you pay in a currency other than the one your card or account is held in, your bank or card provider may charge conversion or international transaction fees. Those fees are set by them, not us.

6.4 We may change our prices at any time, but changes won't affect an order you've already paid for.

6.5 If we make an obvious pricing error, we may cancel the order and refund you in full.

7. Payment

7.1 Payments are processed by Stripe through Stripe Checkout. Depending on your location and device, you may be able to pay by card, Apple Pay, Google Pay, Link or local payment methods. We never see or store your full card details.

7.1A In some countries, Stripe may process your payment as the reseller and merchant of record ("Stripe Managed Payments"). If so, Stripe Checkout will tell you before you pay, Stripe is the seller of record for the payment and handles the sales tax, VAT or GST on it, and Stripe's own customer terms also apply to the payment. These Terms still apply to the portrait and your use of the Site.

7.2 Your order is accepted when your payment is confirmed and we make the download available.

8. Digital delivery

8.1 After your payment is confirmed, we give you a download link on screen. We also save a private order reference in your browser, so you can get back to your download from the same browser on our "Find my order" page (https://draw-paw.com/orders) for the 30 days your file is available. If we email you the link, it will go to the address you provided at checkout.

8.2 Your download link is valid for 30 days. After that, we delete the full-size file and cannot recover it. Please download and save your portrait promptly.

8.3 If you can't download your file, or the link doesn't work within the 30 days, contact us at hello@draw-paw.com and we'll fix it, resend it or refund you.

9. Refunds, redos and cancellation

9.1 Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

9.2 What this means in practice. We will redo your portrait or refund you if your file is faulty, isn't as described, or wasn't delivered. Details are in our Refund & Redo Policy.

9.3 Change of mind. Because you can see a preview before buying and the file is delivered instantly, we don't generally offer refunds for change of mind once you've downloaded your portrait. This does not affect your rights under the Australian Consumer Law or other consumer laws.

9.4 Customers in the EU and UK — right of withdrawal. You normally have a 14-day right to withdraw from a contract made online. For digital content that is supplied immediately, that right ends once the supply begins if, before paying, you (a) expressly asked us to begin supply straight away and (b) acknowledged that you would lose your right of withdrawal. We ask for this consent at checkout and confirm it in your order confirmation. If you did not give that consent, you can withdraw within 14 days of purchase by emailing hello@draw-paw.com. Your rights if the digital content is faulty or not as described are not affected.

10. Our responsibility to you

10.1 We provide the Site with reasonable care and skill. However, to the extent permitted by law, we don't guarantee that the Site will always be available, uninterrupted or error-free.

10.2 Subject to clause 10.4, and to the extent permitted by law:

10.3 We are not responsible for loss caused by your breach of these Terms, by Your Content, or by events beyond our reasonable control.

10.4 Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including under the consumer guarantees in the Australian Consumer Law, liability for death or personal injury caused by negligence, or liability for fraud. If you are a consumer in the EU or UK, nothing in these Terms affects your statutory rights.

11. Your responsibility to us

To the extent permitted by law, you agree to compensate us for reasonable losses and costs (including reasonable legal costs) we incur because of a third-party claim that Your Content infringes their rights or breaks the law. This does not apply to the extent the loss was caused by us.

12. Privacy

We handle your personal information as described in our Privacy Policy. In short: your uploaded photo is sent to OpenAI to create the artwork and is not stored by us; we keep the generated artwork only for a limited time.

13. Suspension

We may suspend or refuse access to the Site if we reasonably believe you have breached these Terms, are misusing the Site or are acting unlawfully. If we cancel a paid order for a reason that isn't your fault, we'll refund you.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law or our service. The version in force when you place an order applies to that order. We'll post the updated Terms on the Site with a new effective date.

15. Complaints and disputes

15.1 If something goes wrong, please contact us first at hello@draw-paw.com. We aim to reply within 2 business days and to resolve complaints within 14 days.

15.2 If you are in Australia, you can also contact your state or territory fair trading agency (in New South Wales, NSW Fair Trading). If you are in the EU or UK, you can contact your local consumer authority.

16. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales and courts that can hear appeals from them have non-exclusive jurisdiction. If you are a consumer living outside Australia, this does not take away the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in your local courts where the law allows.

17. General

17.1 If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply.

17.2 If we don't enforce a right straight away, we can still enforce it later.

17.3 You may not transfer your rights under these Terms without our consent. We may transfer our rights and obligations to a business that takes over Draw Paw, as long as your rights are not reduced.
